Disclaimer & Limitation of Liability
This Disclaimer explains what Safon ("the App"), provided by Argos ("we", "us", "our"), does and does not promise. By purchasing, activating, or using Safon, you ("the Customer", "you") agree to the terms below.
1 Safon is a deterrent and locating aid — not a guarantee
Safon is designed to make a stolen phone harder to use and to help locate it. Safon does NOT guarantee that a lost or stolen phone will be found, recovered, or returned to you, and does not guarantee that any person responsible will be identified or caught.
Success depends on factors outside our control, including network coverage, whether the phone has power, internet or SMS access, the actions of the person holding the phone, and the response of local authorities.
2 We are not responsible for the loss of your phone
We are not responsible if your phone is lost, stolen, or damaged. Safon reduces risk but cannot prevent theft, loss, or damage from happening.
3 We are not responsible for searching, recovering, or retrieving your phone
Safon provides information (such as a location link) to help you and the authorities act. Searching for, physically recovering, or retrieving the phone is your responsibility and/or the responsibility of local police — not ours.
We do not send agents to retrieve phones, do not guarantee any response time, and do not guarantee that any location information provided is exact, current, or complete.
4 Limits of the protection
Safon reduces the chance of theft and resale but cannot make a phone completely theft-proof against every method or every determined attacker.
Protection depends on correct setup (Device Owner mode where applicable) and on the customer keeping their PIN and trusted contact information secure and up to date.
Location reporting requires network, GPS, or internet connectivity on the phone. If the phone has none of these, Safon cannot report its location.
5 Limitation of liability
To the maximum extent permitted by law, Argos's total liability for any claim relating to Safon is limited to the amount the customer paid for the activation of the App. We are not liable for indirect, incidental, or consequential damages, including but not limited to the value of the lost phone, its contents, or any data stored on it.
This limitation does not apply where the law does not allow it to be limited or excluded.
6 Backing up your data
Setting up full protection (Device Owner mode) requires a factory reset in most cases, which erases the phone. It is the customer's responsibility to back up photos, contacts, and other data BEFORE setup. We are not responsible for any data lost during setup, reset, or recovery.
7 Your PIN and account security
The customer is responsible for keeping their Safon PIN secret and for keeping their trusted contact information correct. We are not responsible for actions taken by anyone who obtains the PIN, whether through the customer's action or otherwise.
